If a private columbarium ceases operation or fails to obtain a licence, what will happen to the ashes interred in niches of the columbarium? Are the purchasers of the niches of the private columbarium entitled to compensation?

  • If a columbarium ceases operation or fails to obtain a licence, an exemption or a TSOL upon the expiry of the grace period, the operator is required to return the ashes to the eligible claimants according to the law.  For questions relating to the handling of the ashes returned, please refer to alternative means of disposal of ashes.
  • Since the issue involves private agreements of sale and purchase, the purchasers of the niches should discuss the matter of compensation with the operator of the private columbarium and seek legal advice if necessary.
