Is cycling under the influence of drink or drugs an offence?
Transport DepartmentIn addition to being very dangerous, cycling after drinking is also an offence under Section 47 of the Road Traffic Ordinance (Cap. 374). Any person who is unfit to ride or drive through drink when using or riding a bicycle on a road or in a public place commits an offence. The application of this ordinance is not just limited to "drink-cycling", but also applies to cycling when under the influence of drugs.
A person is liable to a fine of HK$500 for the first conviction. In the case of a second or subsequent conviction, he or she shall be liable to a fine of HK$1,000 and to imprisonment for 3 months.
