What are the consequences of failing to comply with statutory notices for Mandatory Building Inspection?

A registered owner or the Owners' Corporation (OC) of a building may be prosecuted:

OffenceFine/ Imprisonment

Failing to comply with a statutory notice for Mandatory Building Inspection

A fine of HK$50,000 and imprisonment for 1 year; and a fine of HK$5,000 for each day during which it is proved to the satisfaction of the court that the offence has continued

Refusing to contribute to the cost of inspection, investigation, works or other action in relation to the common parts of the building

A fine of HK$25,000

Obstructing or refusing to allow a person appointed or engaged by the OC to access to any premises to carry out an inspection or repair works

A fine of HK$10,000 and imprisonment for 6 months

The Buildings Department may also arrange for the required inspection and repair works to be carried out by its consultant and contractor, and then recover the cost of inspection and repair works as well as supervision charge from the owners/OC, together with a surcharge of not exceeding 20% of the cost.
