1823 Mobile App "Tell me@1823" - Terms of Use

“Tell me@1823” is provided by 1823, Efficiency Office of the Government of the Hong Kong Special Administrative Region. The purpose of this app is to enable you to lodge the following with 1823: enquiries regarding the 23 participating government departments, and complaints, suggestions and compliments about all government services through the e-forms in the app.

 

Acknowledgment and Agreement

By installing, accessing or using “Tell me@1823” or otherwise using any functions or information found therein, you, as user of this app, acknowledge and agree to be bound by the Terms of Use, Privacy Statement, Disclaimer and other related conditions (together, the “Terms and Conditions”), which may be amended by 1823 from time to time without prior notice.

You shall abide by these Terms and Conditions until you terminate your use of “Tell me@1823” by uninstalling it and destroying all copies of it in your possession. However, termination in all the circumstances shall be without prejudice to any of our and your rights or remedies which have accrued prior to such termination.

1823 will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage (including without limitation consequential loss, destruction or damage) however arising from or in respect of any use or misuse of or reliance on the service delivered through "Tell me@1823".

 

Use of the App

Subject to your compliance with these Terms and Conditions, we grant you permission to use "Tell me@1823", provided that you will not decompile, reverse-engineer, translate, convert, adapt, alter, modify, enhance, customise, repair, add to or delete all or any part of "Tell me@1823", or make any attempt to do so. We may revoke the permission to use "Tell me@1823" forthwith upon your breach of any of these Terms and Conditions.

You should not act maliciously in your use of "Tell me@1823". You are liable for all direct and indirect legal consequences, losses and damages if you act with malicious or fraudulent intent.

You are free to choose to allow “Tell me@1823” to collect, use and/or access certain features on your mobile device and personal information, including camera, photo album, files, microphone, and location, etc., in order to enable certain functionalities. You can use the Chatbot function through the link in "Tell me@1823" for simple enquiries. When using the Chatbot function, your conversation with the Chatbot will be recorded by the system for 1823 to understand the performance of the Chatbot and improve it. Please refer to the Privacy Statement for details.

1823 may use the push notification function on your mobile devices to notify you of any new replies to your cases through third party messaging services. Any delay or failure in delivering the notifications due to the third party messaging services is beyond our control. Each push notification will be sent once only. If you delete the push notification, “Tell me@1823” cannot recover it. You can enable or disable the notification function at any time by changing the notification settings on your mobile device. If you choose not to receive push notifications, you will still receive case replies in “Tell me@1823”.

You do not need to create an account in order to use “Tell me@1823”. By inputting your personal data for the use of this App, you consent and agree to our use of your personal data for the purposes of “Tell me@1823” and all other purposes incidental to it.

We do not guarantee that “Tell me@1823” and related services can be used in other regions outside Hong Kong. 

It is your responsibility to make sure you have cellular data internet connection or WiFi internet connection in order to use “Tell me@1823”.  “Tell me@1823” is made available for use free of charge, but you should be mindful that your mobile network service provider may charge you for using the mobile data network. When using roaming services in regions outside Hong Kong, you may have to bear additional service charges for using “Tell me@1823”.
 

Update of the App

You are advised to use the latest version of "Tell me@1823" for the security patches, updates and upgrades. We do not guarantee that we would provide any updates for "Tell me@1823", or that such updates will continue to support your device or system. Please download and install updates regularly to continue access to “Tell me@1823”.

 

Information Security

You are responsible for taking all reasonable precautions to keep your mobile device and data in “Tell me@1823” safe, and prevent any unauthorised use. The precautions may include the following –

  • set a password for your mobile device and always turn on the Security Lock function;
  • take care to ensure that no one sees it when you enter your password and undergo data migration;
  • ensure that your biometric credentials stored on your mobile device are your own and do not store anyone else's biometric credentials on your mobile device and that you only use your own biometric credentials to log on; and
  • do not leave your mobile device unattended or let anyone else use your mobile device.

You must not use “Tell me@1823” on any device or operating system that has been modified outside the configurations supported or warranted by the mobile device or operation system vendor(s). This includes devices that have been “jail-broken” or “rooted”. A jail-broken or rooted device means one that has been freed from the limitations imposed on it by the mobile service provider and the device manufacturer without their approval. The use of “Tell me@1823” on a jail-broken or rooted device may compromise information security and lead to unauthorised or fraudulent accesses. You also must not use “Tell me@1823” if your device contains any pirated, hacked, fake or unauthorised applications.

Downloading, accessing and/or using “Tell me@1823” on such devices is entirely at your own risk and 1823 shall not be liable for any losses or any other consequences suffered or incurred by you as a result.

 

Governing Law

These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region. You agree to submit to the exclusive jurisdiction of the Hong Kong courts.
