I just let my property. Is it necessary to submit the Form CR109 to the Rating and Valuation Department (RVD)?
Rating and Valuation DepartmentAccording to Part IV of the Landlord and Tenant (Consolidation) Ordinance (“the Ordinance”), a landlord shall not be entitled to maintain an action to recover rent under the relevant tenancy agreement unless the Notice of New Letting or Renewal Agreement (CR109) is endorsed by the Commissioner of RVD.
RVD will send the copy of the endorsed form to the landlord and the tenant (note) separately. If the tenant notices that details claimed by the landlord is different from his/her understanding, he/she may request RVD to contact the landlord to make amendment.
(Note) Under the Ordinance, landlord includes any person, other than the Government, who is, from time to time, entitled to receive rent in respect of any premises and, in relation to a particular tenant, means the person entitled to receive rent from that tenant.
