I just let my property. Is it necessary to submit the Form CR109 to the Rating and Valuation Department (RVD)?

According to Part IV of the Landlord and Tenant (Consolidation) Ordinance (“the Ordinance”), a landlord shall not be entitled to maintain an action to recover rent under the relevant tenancy agreement unless the Notice of New Letting or Renewal Agreement (CR109) is endorsed by the Commissioner of RVD. 

RVD will send the copy of the endorsed form to the landlord and the tenant (note) separately. If the tenant notices that details claimed by the landlord is different from his/her understanding, he/she may request RVD to contact the landlord to make amendment.

(Note) Under the Ordinance, landlord includes any person, other than the Government, who is, from time to time, entitled to receive rent in respect of any premises and, in relation to a particular tenant, means the person entitled to receive rent from that tenant.


The application procedures for endorsement of the Notice of New Letting or Renewal Agreement is as follows -
 

Form and Means of Submission
  • Submit Notice of New Letting or Renewal Agreement (e-CR109) through RVD website; or 
  • Submit Notice of New Letting or Renewal Agreement (CR109) in person or by post to RVD 
    (address: 15th Floor, Cheung Sha Wan Government Offices at 303 Cheung Sha Wan Road, Kowloon
    Opening hours: Mondays to Fridays: 8:15 am to 6:00 pm, except Saturdays, Sundays and public holidays
  • Note:
    • fax submission will not be accepted
    • if the tenancy involves more than one assessment numbers, please provide the numbers in one CR109 
       
Fees

Free of charge if the notice is lodged within 1 month from the date on which the parties entered into or renewed a tenancy.  A fee of $310 will be charged if the notice is lodged after 1 month from the date on which the parties entered into or renewed a tenancy.  
 

Payment Methods
  • E-submission: online payment by PPS or Credit Card immediately, or by a crossed cheque within 14 days after e-submission
  • In person: cash or cheque
  • By post: cheque
    (Cheque should be crossed and made payable to “The Government of the HKSAR”.  Postal address: 15th Floor, Cheung Sha Wan Government Offices at 303 Cheung Sha Wan Road, Kowloon)
     
Processing Time
  • About one month. RVD will send a copy of the endorsed form to both landlord and tenant by post.  
  • Applicants submitted application online can choose to download e-endorsement in PDF format.  RVD will send the hyperlink for download e-endorsement to them.   
     
Checking Progress of Endorsement
  • E-submission:  A Transaction Reference No. will be displayed after e-submission.  Please enter the Transaction Reference No. to check the progress of endorsement online
  • Submission by post or in person: Please contact RVD at 2294 2555.
