Will the new "continuous contract” requirement ("468 Rule") with effect from 18 January 2026 apply retrospectively?

Labour Department

The new “continuous contract” requirement ("468 Rule") will become applicable starting from 18 January 2026.  As the amendments are NOT retrospective, for an employment period before this date, an employee has to be employed continuously by the same employer for four weeks or more and has worked at least 18 hours each week ("418") to meet the “continuous contract” requirement.

This is not a legal document. The Ordinance remains the sole authority for the provisions of the law explained.
